In language reminiscent of the Trump administration’s threats against Twitter last year, the Centre says Twitter’s legal status as an intermediary might be called into question if it does not accede to official demands

New Delhi: The Union government has objected to Twitter labelling as “manipulated media” a tweet containing screenshots of a purported Congress ‘toolkit’ by BJP chief spokesperson Sambit Patra, saying that the matter is pending investigation before a law enforcement agency and amounts to the company prejudging the outcome.

“The Ministry of Electronics and IT has written a strong communication to the global team of Twitter, registering its objection to the use of ‘manipulated media’ tag on certain tweets made by Indian political leaders with reference to a toolkit created to undermine, derail and demean the efforts of the government against the COVID-19 pandemic,” an unidentified ministry source was quoted by PTI as saying.

“Such a tag by Twitter appears to be pre-judged, prejudiced and a deliberate attempt to colour the investigation by local law enforcement agency”, the sources said and added that the ministry had termed such unilateral action by Twitter as an effort to influence the fair investigation process and “a clear overreach, which is totally unwarranted”.

This is the first time the government has cited due process in defence of a social media post.

In the past, Twitter has been asked to take down content and block handles, including of a reputed media platform like Caravan magazine on the basis of directives from the government. Many of those takedown requests involved matters where the police had either filed omnibus FIRs or was in the process of conducting investigations and the Ministry of Electronics and Information Technology has never previously said that such action amounted to “prejudging” the issue.

This time, however, the ministry says that only the police’s investigation will determine the veracity of the content and not Twitter, and has asked the social media company not to interfere in the investigation process.

The ministry further communicated to Twitter that a complaint has already been made by a concerned party before the local law enforcement agency questioning the veracity of the toolkit and the same was under investigation. While the investigation is underway, Twitter has unilaterally drawn a conclusion in this matter and arbitrarily tagged it as ‘manipulated media’, the government sources said.

The unidentified sources alleged that such action not only dilutes the credibility of Twitter as a neutral and unbiased platform facilitating an exchange of views by the users but also puts a question mark on Twitter’s status as an “intermediary”. The reference to Twitter’s legal status as an intermediary is a threat that is reminiscent of action the Trump administration attempted to take when Twitter began acting against fake news promoted by Donald Trump and his supporters last year.


In its policy on designating content as manipulated media, Twitter says,“…we may label Tweets that include media (videos, audio, and images) that have been deceptively altered or fabricated. In addition, you may not share deceptively altered media on Twitter in ways that mislead or deceive people about the media’s authenticity where threats to physical safety or other serious harm may result.”

Twitter, which has previously employed similar warnings on tweets by former US President Donald Trump about voter fraud after the 2020 elections, decided to flag Patra’s tweet after the Congress complained to the social media platform that the ensemble of pages, circulated as the party’s ‘toolkit’ by top BJP leaders, was fake. Fact-checking website AltNews had also published a comprehensive report establishing that the document which the BJP’s top leadership has been circulating on social media was created on a forged Congress letterhead.

A number of BJP and RSS leaders had tweeted about the alleged toolkit with the hashtag #CongressToolKitExposed to attack the Congress party on social media. “Friends look at the #CongressToolKit in extending help to the needy during the Pandemic! More of a PR exercise with the help of “Friendly Journalists” & “Influencers” than a soulful endeavour,” the tweet by Patra said.

The document contained a range of purported social media directives for party workers to use to attack the prime minister for his disastrous handling of the current wave of the Covid-19 pandemic.

The Congress on Thursday also wrote to Twitter asking it to permanently suspend the accounts of BJP leaders J.P. Nadda and Union minister Smriti Irani for “spreading misinformation and unrest in the society”. A day earlier, the party had lodged a police complaint seeking registration of cases against Nadda and Irani, in addition to BJP general secretary B.L. Santosh and spokesperson Sambit Patra over the alleged forgery of documents.

ChetakJi, I beg to differ. Do you think the white honchos in charge of Twitter are twiddling their b@alls in fear because ModiJi asked them to remove manipulated media tag at the behest of Pappu's slaves? I just read today that in fact Twitter tagged even more posts with that tag. Thats what the weak people get, contempt and disdain.

Look at it objectively. White bahadur Twitter become the court arbiter, judge, and jury; and the natives: both Pappu slaves and BJP cowards bend down on their knees and beg Twitter to put the other guy down. And we thought India was an independent country. Ackkk Thoo. If wishes were horses, beggars would ride, but what stops ModiJi from issuing a temporary ban on Twitter in India? I know NYT/WP and Pappu slaves will scream 'fascism', but so f!king what? They call him one anyway.

I mean the heat is being piled up on BJP, thx to 2nd Covid wave. And all we get from BJP is useless defense. CRamS, I’d like to mention something else especially around Kangana. At first, I used to think, why is she really going out on the offensive with sometimes negative consequences? She has frequently come out with statements that even I would think initially were a little dubious. However, time again has proved me wrong with regard to her strategy.

She has absolutely been on the right track I now feel all along. It’s quite clear that the BIF are on the offensive while we have been solely doing the patchwork of defense.

While I hate to say it, the apt line is that if you’re not with us, then you are against us.
Too really come back from the media blitzkrieg that has taken place over the last two months will take years. It was a disaster the whole Abrahamic world was salivating for and awaiting any opportunity to criticize instead of help. Instead of help, what we got again was trying to demonize the origins of the second wave being solely Kumbh and Kumbh.

What we need are hell of a lot of more Kangana’s. Each of us has to make that choice, about not setting on the fence anymore. It’s time for all of us can be influencers to openly come out and voice of these concerns again and again.

Yesterday Aditya was telling me that all of those dead bodies found in the Ganges were ripped out from coffins and dumped into the Ganga, strictly with the purpose of trying to make the UP government and Yogi look completely incompetent. Don’t Hindus completely cremate? So who else is responsible?

What Yogi has achieved in the last month has been nothing short of incredible with regard to the positivity rate at just over 2%.

It’s time that we seek out influencers and all Hindus sound the war Conch against this media war.

I don’t know to really think of this whole situation with regard to tendering for global vaccines. I think the government was left in a bind been states started to ask for outside companies with regard to vaccine production. Yes, India needs vaccines, but can we really count on Pfizer or Moderna, or even the United States and Europe to start donating their vaccines to us?

I mean WTH, were states like Delhi and Punjab and Kerala really thinking. Of course, nothing really to do with their population just trying to score more political points which yet again exploded back in their face. After releasing global tenders, these vaccines, all they received was a resounding deafness.

Not one country or company responded to any states pleas. How can they? They’re too busy vaccinating their own populations.
United States so far has only exported 3 million vaccine doses or 1% of its total vaccine supply. Kejriwal, is now touting that only the center can request vaccines for the states.

All of these states previously have refused the Covax vaccine, contributing to the second surge and now after their tenders have fallen flat on their face are now begging for the Center to ask to save face.

On another note, I think we should try to do all we can in trying to show that the super spreaders are really related to the farmer protests. One only needs to look at social media sites to show that none of these farmers are really caring about social distancing or mask wearing. God only knows how many of them have been affected and probably lives lost in their encampments of moon. Not only that if they fall sick bank then return to the villages to spread it even further.

India already has a plan to ramp up the falsely maligned Covax vaccine which is shown efficacy data better than AstraZeneca. Talking about hundreds of million doses by the end of the year. That is what usually should be focusing on.

WhatsApp sues Indian govt, says new media rules mean end to privacy

Lawsuit escalates a growing struggle between the government and tech giants in one of their key global growth markets

WhatsApp has filed a legal complaint in Delhi against the Indian government seeking to block regulations coming into force on Wednesday that experts say would compel the California-based Facebook unit to break privacy protections, sources said.

The lawsuit, described to Reuters by people familiar with it, asks the Delhi High Court to declare that one of the new rules is a violation of privacy rights in India's constitution since it requires social media companies to identify the "first originator of information" when authorities demand it.

While the law requires WhatsApp to unmask only people credibly accused of wrongdoing, the company says it cannot do that alone in practice. Because messages are end-to-end encrypted, to comply with the law WhatsApp says it would have break encryption for receivers, as well as "originators", of messages.

Reuters could not independently confirm the complaint had been filed in court by WhatsApp, which has nearly 400 million users in India, nor when it might be reviewed by the court. The people with knowledge of the matter declined to be identified because of the sensitivity of the issue.

A WhatsApp spokesman declined to comment.

The lawsuit escalates a growing struggle between Indian Prime Minister Narendra Modi's government and tech giants including Facebook, Google parent Alphabet and Twitter in one of their key global growth markets.

Tensions grew after a police visit to Twitter's offices earlier this week. The micro-blogging service had labelled posts by a spokesman for the dominant party and others as containing "manipulated media", saying forged content was included.

The government has also pressed the tech companies to remove not only what it has described as misinformation on the COVID-19 pandemic ravaging India, but also some criticism of the government's response to the crisis, which is claiming thousands of lives daily.

The response of the companies to the new rules has been a subject of intense speculation since they were unveiled in February, 90 days before they were slated to go into effect.

The Intermediary Guidelines and Digital Media Ethics Code, promulgated by the ministry of information technology, designates "significant social media intermediaries" as standing to lose protection from lawsuits and criminal prosecution if they fail to adhere to the code.

WhatsApp, its parent Facebook and tech rivals have all invested heavily in India. But company officials worry privately that increasingly heavy-handed regulation by the Modi government could jeopardize those prospects.

Among the new rules are requirements that big social media firms appoint Indian citizens to key compliance roles, remove content within 36 hours of a legal order, and set up a mechanism to respond to complaints. They must also use automated processes to take down pornography.

Facebook has said that it agrees with most of the provisions but is still looking to negotiate some aspects. Twitter, which has come under the most fire for failing to take down posts by government critics, declined to comment.

Some in the industry are hoping for a delay in the introduction of the new rules while such objections are heard. The WhatsApp complaint cites a 2017 Indian Supreme Court ruling supporting privacy in a case known as Puttaswamy, the people familiar with it said.

The court found then that privacy must be preserved except in cases where legality, necessity and proportionality all weighed against it. WhatsApp argues that the law fails all three of those tests, starting with the lack of explicit parliamentary backing.

Experts have backed WhatsApp's arguments. "The new traceability and filtering requirements may put an end to end-to-end encryption in India," Stanford Internet Observatory scholar Riana Pfefferkorn wrote in March.

Other court challenges to the new rules are already pending in Delhi and elsewhere. In one, journalists argue that the extension of technology regulations to digital publishers, including the imposition of decency and taste standards, is unsupported by the underlying law.

Actually a agenda is running by SP and congress for 2022 election in UP. Police has arrested one person named Nadeem regarding this body floating issue in Ganga. Further investigation is in progress. Yogiji has really done a great work for corona. Up has some 28 crore people but the way he has managed it is really appreciated. He has organised small teams for villages. HE has started a campaign call MERA GAON CORONA FREE GAON. The way he has managed oxygen and other health facilities is really great. On the other hand Delhi has 1.9 crore people and Kejriwal is crying over the oxygen and other health facilities.

Guys, I am a great admirer of Baba Ramdev, he is a simpleton Hindu son-of-the-soil who has brought the power of Yoga, pranayama, and Ayurveda to millions of ordinary people, and he has built a business empire thats the envy of many multi nationals. Now having said that, today though I am gnawing my teeth at the anti-allopathy cacophony from Ramdev. Don't get me wrong, he makes legitimate points on allopathy not being able to cure many ailments, and often-times, allopathy has harmful side effects. But with a Covid pandemic raging, and allopathic treatments, if you can call them that, are the only ones available and in many cases life saving like vaccines, is this the time for Ramdev to attack allopathy?

And furthermore, while Yoga, pranayama, and Ayurveda are great practices for holistic health, his Bombastic claims of those practices curing everything under the sun is as bogus if not worse than the pitfalls of allopathy that he attacks. So IMO, if one suffers a sudden injury, or a sudden illness like heart attack, you need allopathy. But to maintain overall good health, a combination of Yoga, pranayama, and Ayurveda can surely go a long way. So its not either allopathy or Ayurveda, both have their place.

But as I said, this debate or discussion should take place at the appropriate time. Timing is everything. So I would sincerely hope Rmadev keeps quiet, and let doctors do what they can. Or else everytime he opens his mouth during these trying times, he loses credibility and hurts BJP too in the process

Baba Ramdev, From what I understand has issued an apology. In the end he had to, as Dr. Harsh Vardhan had to basically inform him that his statements were demoralizing to the front line Covid Warriors.

Unfortunately I think he often suffers from foot-in-mouth syndrome. Swarajya had a pretty good article on this which i’ll post below. In a crisis like this, all front-line workers really have had to step up to the wicket, and criticizing any of them will always look In bad taste.

I think there is a point to be said with regard to the Indian Medical Association run by Dr Johnrose Austin Jayalal (a Christian), Who simply won't accept his apology and continues to run the negative narrative for obvious political means.

Also, we can all realize the amount of trauma that most Indians have faced over the last month. Every day that I call or talk to family all you hear is of distant family members or even friends severely affected by covid.

It seems that what really happened over the last month was nothing short of a war. The effects of this trauma or going to take a significant amount of healing time before we can really understand its effect.

Unfortunately, politically we don’t seem to have a lot of time for that healing with Bengal always in the news media among the standard usual suspect fools that we know including Kejriwal.

On some points you are right Muns all opposition and Indian Medical Association run by Dr Johnrose Austin Jayalal (a Christian) are playing a political game on this. But he should not participate in this controversy for now because whole country is struggling with covid and people are also not liking his statements. Rajasthan reported the highest percentage of Covid-19 vaccine wastage. According to a report by Hindi daily Patrika, a total of 11.5 lakh doses of Covid-19 vaccine, which amounts to almost 7 per cent, has been wasted in the Congress-ruled state.

Though many districts in Rajasthan have reportedly wasted several doses of vaccines, the wastage rate recorded in Rajasthan’s Churu district stood the highest at 39.7 per cent, followed by Hanumangarh, where the waste per cent was recorded to be 24.60 per cent. Bharatpur stood at number three after it reported 17.13 per cent. Kota finished fourth with a 16.71 per cent of waste rate.

The fragile and unique ecosystem of the archipelago will collapse if steps are not taken to reverse the new draft law, says Lakshadweep’s sole MP, P.P. Mohammed Faizal

Forever thought to be a tranquil abode of corals, lagoons and a peaceful people, the Union Territory of Lakshadweep, in the Arabian Sea to the west of Kerala, made sudden headlines a few weeks ago. Widespread protests had erupted over a slew of new development regulations that were announced seemingly unilaterally by Lakshadweep’s new administrator, Praful Khoda Patel.

A campaign for the recall of the ‘insensitive’ administrator has now gained national momentum, with the island chain’s elected representatives, including its Panchayat members, and the sole Member of Parliament, P.P. Mohammed Faizal, seeking a restoration of democracy. Excerpts from an interview with Faizal:

Why did the new ‘development proposals’ rattle the calm political environs of Lakshadweep?

There were ongoing development projects in Lakshadweep well before Mr. Patel arrived. For example, when we needed specialist doctors during my first term as MP, we sought the help of the National Health Mission to contract doctors for a specified period in Lakshadweep. Agatti island had the service of some specialists but we wanted to extend it across Kavaratti, Androth, Amini and Minicoy islands. A monthly grant of ₹2 lakh was offered and the experience criterion was relaxed, but the response was tepid.


So we changed tack and called for tenders from hospitals to delegate doctors for one year. It worked and we got 35 specialists available round-the-clock. Hospital infrastructure and facilities were upgraded in tandem.

These contracts were set to expire when Mr. Patel arrived and without bothering to consult anyone, he ordered a return to the old, unviable system, which has reduced the number of specialists and their 24x7 availability. And how many days has Mr. Patel spent on the islands in the past six months to understand the ground realities? Hardly 15 days!

Secondly, all islanders evacuated to Kochi on medical grounds used to be covered under a comprehensive medical insurance scheme specific to Lakshadweep. Mr. Patel replaced it with Ayushman Bharat, which restricts the benefit to just BPL families. Worse, very few hospitals in Kochi are empanelled under Ayushman Bharat. The result is that treatment expenses are on the islanders now.

Work on a 100-bed hospital in Kavaratti, whose foundation was laid by President Ramnath Kovind, was 30% complete when the district collector halted it, citing the draft Lakshadweep Development Authority Regulation (LDAR) and claimed at a press conference in Kochi that the administration would build a new hospital. Hundreds of workers have been retrenched. The people are put to untold hardship amidst a raging pandemic.

All draft notifications were in English and published on the Internet with just 20 days for people to respond. What was the tearing hurry? The people’s representatives learnt about the proposals just like the commoner. While they speak volumes about federalism, where’s the federal system here?

So, there were no consultations while these reforms were drafted?

We have a two-tier panchayat system and a district planning committee in which chairpersons of village panchayats, the MP, the district panchayat president, members and officers are members. The drafts weren’t discussed anywhere. Mr. Patel will go back when his tenure ends, but the island belongs to us and we live here. Democracy demands that reforms are discussed with us.

But the argument is that the legislations are still in draft form…

The draft notification for the Goonda Act (Lakshadweep Prevention of Anti-Social Activities Regulation) came in December and I’m not sure if it incorporated comments by the people before it was forwarded to the ministry. The Lakshadweep Animal Preservation Regulation [that bans beef on the Muslim-majority islands]; the Lakshadweep Panchayat Regulation [which clips the wings of democratically elected representatives] have all been sent. Only the LDAR is probably left.

But hasn’t it been in the works for some time now? The contention is that the Island Development Agency was formed for ‘holistic development’ in keeping with the Integrated Island Management Plan (IIMP).

I am a member of the advisory committee chaired by the Union Home Minister, which evaluates the overall development of the islands and of Centre-sponsored schemes. The committee hasn’t discussed any of these regulations.

As for the IIMP, it has been accepted and notified by the government, on the basis of which local entrepreneurs submitted several proposals that have been pending with the department of tourism for several years now. Why is the District Collector, who heads the tourism department, not granting permission to local entrepreneurs?

Lakshadweep is a place where VVIPs roam about without any security. The Collector has maligned the island, saying AK-47s have been seized, drug running has been unearthed. The archipelago is surrounded by international waters, where these seizures were made. Till date, not a single islander has been connected with these incidents.

Are you suggesting an ulterior motive behind the moves?

When the people of Kiltan protested the District Collector’s irresponsible statement, they were arrested for violating curfew. There was also an attempt to foist sedition charges on them. There’s a concerted move to justify the Goonda Act. Their intent is to implement LDAR, but see how the discussion was diverted to banning beef and introducing liquor on the islands. If LDAR, which has several downright foolish sections, is discussed, one would ask why Lakshadweep, whose largest island has a surface area of just 4.9 sq. km., needs a highway or a quarry.

Do you suspect that someone is eyeing the land on the uninhabited islands?

That’s the crux of the matter — land. The islanders have for decades cultivated on Pandaram land, and there was an effort to notify and regularise all transactions in relation to Pandaram land till December 2019. It was notified in the gazette and the framing of the rules for awarding occupancy was in the final stages when Mr. Patel came and questioned why people should have land on uninhabited islands. The creation of LDAR is targeted at the agricultural land, low-lying and underdeveloped, held by the islanders on uninhabited islands. These areas can be easily taken over in the name of tourism development. This is a way to grab land officially, and then lease it out. This is legalised land grab.

Are the islanders ecologically aware?

The islands are made of coral, which takes centuries to grow. The comparison with the Maldives is faulty because it has numerous uninhabited islands. Lakshadweep is tiny and densely populated and any development should be in tune with the IIMP. If you do it mindlessly, the island ecosystem will collapse and it’s our home, not Patel’s. A vast number of islanders have over time become aware of the fragility of its ecology. Sea cucumber is abundantly seen off these islands and their excretion feeds the corals. The islanders now know that if exploited extensively, this food chain breaks, threatening the existence of the corals.

With legislations still in draft form, it is alleged that panchayats are being denuded of powers.

They have thrust a dagger into democracy by divesting the panchayats of control over five major departments like agriculture, fisheries and animal husbandry, which directly contribute to people’s lives and welfare. We have written to the President and the Prime Minister. We are going to fight in the court too. We are now awaiting the Centre’s response. We will not succumb to any pressure and are ready to face the consequences.

The standard Lutyen line is that Covid 2.0 devastation caused by mismanagement by YogiJi in UP: 'floating bodies in the Ganga' their favorite theme coupled with farmer anger is ging to cist BJP dearly in UP. Have there been an opinion polls done in the recent past?

I would think there would be some level of anti-incumbency, some anger on the pan and suffering caused by Covid (and its natural YogiJi at the helm will be blamed whether or not he deserves it), but by and large YogiJi remains popular.

Actually yogi ji has done a fabulous job in covid situation, Some people are angry because they have lost their relatives and family members. But UP is such a big state population wise still yogi ji has controlled the cases and planted oxygen plants before any states. Pappu and media is doing whatever they can do because they know 2022 elections are near. They was trying to highlight the floating body issue but it was totally planned. Police has arrested a guy called Nadeem who was taking out the bodies. But people knows what is the right and wrong for the states. Yogiji has same popularity. But the leaders like kesav prsad Maurya and dinesh sharma are really not doing nothing. They both are dy cm for UP.

Muns. et. al, especially friends in India, what is the buzz with Arnab Goswami of republic TV. Yesterday, I saw this splash that Arnab is back. Why did he leave in the first place? Was he away due to Covid. As much as I detest him for his loud mouth and obnoxious on air behavior and the manner in which he conducts unwatchable debates (nah monologues), I still find him useful as he et least puts India first and takes on the Lutyen colonized frauds. So I did not even know that he was not on air since Bengal elections were over. So anyone knows why he was away?
