Why are Cong and JD acting so desperate? Single largest majority party is but expected to be invited first. And it's still subject to dismissal if they cannot cobble up majority in 15 days.

Absolutely! AS is the master strategist. I am quite sure they will manage the numbers.

However, it will be a travesty of justice if the SC grants a stay to the swearing in tomorrow morning. This IMHO is the litmus test for the CJI.

In midnight hearing SC decides no stay on BJP led govt swearing: rumors are rife that 5 MLAs from the other side will abstain.

No stay on ceremony but the BSY has to submit the letter by 2 pm. and show the numbers.

Which means they are taking cognizance of whether the numbers were there and who should have been called.

That is little moral victory for singhvi?

Any list that is submitted, does it have to be binding? I mean BJP can definitely furnish a list of additional non BJP MLAs with whom they have been having discussions on seeking their support. Whether or not they will actually support BJP on the 15th day on the floor of the legislature is another matter. How will court decide on the surety of BJP's claim?

I believe the FCRA was amended to exempt political parties. If someone can confirm this exemption please?
The law to allow foreign funding to political parties was printed by RSS ( = BJP = NaMo). Thats why, now RSS = BJP is referred as FFPP i.e. "Foreign Funded Political Party", and all RSS-leaders and all RSS-workers (except Modiji *) are now referred as foreign agents. And congress/aap too are now FFPP because they really didnt oppose these laws. How much money RSS = BJP took from foreigners is now non issue, because they printed the law that enables political parties and leaders to OPEN accept money from foreigners using legally confidential means

(* - I add text "except Modiji" in my BRF posts because admins have ruled that one cant make allegations against Sri Modiji !!)

----------

Pls see wiki pages of Karnataka election 2004, 2008, 2013 and 2018

Between 2004 and 2008 , RSS's vote share increased from 28% to 36%
After that, RSS's vote share has been same !!
And same for other 2 parties - more or less
RSS's vote share in may-2018 election is same may-2013 election

So at ground level, there is no MAJOR shift in voters' loyalties.

anecdotal feedback from a friends maid in belanduru ORR here is congis paid her 2k and bjp 1k.
...
when people themselves are this transactional and make up 60-70% of the electorate one has to worry....
over 90% of IAS , IPS, judges, Ministers, MLAs etc decide based on money and other benefits they get
and over 99% of journalists, be shourie or arnab or sardesai or rubbish kumar are bikau.
and less than 1% of commons change votes because of money

commons may be taking money. If you are offered Rs 1000 to vote for congress, you would refuse to take that money. But if you are offered Rs 1 crore, wont you take it? Well, they are poor and so their threshold is lower than yours.

Taking money isnt same as voting for highest payer.

AAP didnt pay even one voter in delhi-2015 elections. And yet aap got over 50% votes.

so problem of voter buyout is exaggerated by 100 times. The real problem is sellout by Nbjpri.

Overall did BJP make any gains? If so is it enough to tip the scales for them to take over the Bengaluru local body (the congies are in charge inspite of BJP having a majority of corporators).

IMHO what BJP should do is furnish a list that includes in addition to its own MLAs, least 5 of JDS & 5 of Congi! Its very simple! SC can not be the venue that decides if Government of the day will prove its majority on the floor of the house! I am really baffled what will judges decide after reading letters? They cant pass a judgement against a governor in office!

The President of India, along with the Governors of States are immune to judicial proceedings. The privilege emanates from Article 361 of the Indian Constitution:
Constitution of India (Parts I to XXII)
361. Protection of President and Governors and Rajpramukhs
1) The President, or the Governor or Rajpramukh of a State, shall not be answerable to any court for the exercise and performance of the powers and duties of his office or for any act done or purporting to be done by him in the exercise and performance of those powers and duties:
Provided that the conduct of the President may be brought under review by any court, tribunal or body appointed or designated by either House of Parliament for the investigation of a charge under article 61:
Provided further that nothing in this clause shall be construed as restricting the right of any person to bring appropriate proceedings against the Government of India or the Government of a State.

(2) No criminal proceedings whatsoever shall be instituted or continued against the President, or the Governor of a State, in any court during his term of office.

(3) No process for the arrest or imprisonment of the President, or the Governor of a State, shall issue from any court during his term of office.

(4) No civil proceedings in which relief is claimed against the President, or the Governor of a State, shall be instituted during his term of office in any court in respect of any act done or purporting to be done by him in his personal capacity, whether before or after he entered upon his office as President, or as Governor of such State, until the expiration of two months next after notice in writing has been delivered to the President or the Governor, as the case may be, or left at his office stating the nature of the proceedings, the cause of action therefor, the name, description and place of residence of the party by whom such proceedings are to be instituted and the relief which he claims.

There are some cases where BJP did not go by this rule. For example Goa & Meghalaya. I feel technically the approach BJP took in these states were correct, but for general populace they may feel that BJP is changing the goal post at their convenience.
crams wrote:Any list that is submitted, does it have to be binding? I mean BJP can definitely furnish a list of additional non BJP MLAs with whom they have been having discussions on seeking their support.
Okay, the BJP only gives the list of 104 MLAs (won from their party) and JD(S) and Congress also gives their list. But the SC cannot dismiss a government through any court orders. There are other channels and authorities who can do that.
Hari Seldon wrote:4 Congress MLAs, Who had gone to bring back 2 missing Congress MLAs, have gone missing themselves.
The ultimate would be the master tour operator of the Congress himself just going missing with 10-12 of his side kicks . He goes missing, while he has ensured that many Congress MLAs are camping at a favourite resort of his.
patni wrote:I sometimes fail to understand why BJP cant effectively rubbish congi shenanigans!
Many such theories are also floated by INC-lackey main stream media channels. Now their reporters are usually clueless on pretty much every thing under the son. Get some journalism diploma from some where, and they think they are the best judges, police & executioners. These kind of constitutional provisions, previous case verdicts etc. are absolutely beyond their comprehension. What they would do next is that if the court verdict is not based on their understanding, blame every one else except themselves.

Well i have zero expectation from media to show any logic! My grouse is why the Additional Solicitors general did not point out absurdity of midnight drama to the court of the Registrar (Judicial)! And on top they allowing it to call in session a 3 judge bench at 2 am? I had like to see some push back on this! What stops government of the day to petition President right away about unconstitutional conduct of bench in agreeing to review a governor of state doing his job (Congis go read article 361) let CJI wake up and dismiss the petition outright.

where are the numbers for BJP?

This is confusing. I do not know why such a high stake game is being played by both BJP and Cong. If BJP looses, Cong will blame BJP and hipe this to such an extent that u can win 2019. Cong loose they will be wiped out in karnataka atleast. I do not know why Rahul is blaming judiciary? They should be grateful to them as they had heard their stupid argument at 12.00 in the night, instead he is blaming it and comparing it with Pak courts.

He wore the green shawl NOT to appease the Muslims. This colour in KA also represents the farmers.
madhub wrote:where are the numbers for BJP?
The BJP, I feel is working on a multi-pronged approach
1) There are around three seats which would have bye-elections. Win all of them, and they increase their tally.
2) Bag the 2 independents. One is already in the bag. There is also a news that some Lingayath MLAs from Northern Kerala could not reach the JD(S) or Congress camp on time. They were said to be delayed due to "traffic blocks". Most likely to avoid the traffic blocks they would have taken the route to the BJP camp ;).
3) Play some games and make sure that some MLAs from JD(S) and Congress camp do not vote against the BJP, or abstain from voting etc.

The fact that the Congress is also equally worried shows that, they also do not have more options left. Kumaraswamy once again played a dirty trick. It is now becoming obvious that BJP had helped the JD(S) in some seats where they have won. The original plan was to have a BJP CM and a JD(S) deputy CM. But once Congress offered Jr.Gowdru the CM-ship he happily jumped ship. This move is now known to all. In an immediate re-elections this will have a negative impact for JD(S).

I would hope that despite the differences in the Governers' actions in Goa and now in KA, etc., there are valid principles behind these decisions. In each case when there is no clear majority, the role of the Governer would have to be to call a party or a coalition that can reliably prove majority when called for. If the Guv were to blindly call the largest party w/o majority that would lead to horse-trading and other shenanigans. In Goa, the Cons were trying to corner the Guv but really did not have enough support from outside while BJP clearly had the coalition sewed up. In KA given how close BJP is to majority and the few seats pending elections, etc, I think the Guv has the leeway to give the BJP the first chance to prove their support in the House.

In general, I think letters and signatures may not be enough. People need to be herded together and seem like they are conscious. Which begs the question what does the SC want to know from lists of names.

Latest news: One MLA Anand Singh who took the route BJP->Congress->BJP is now firmly back in the BJP camp. Another MLA has vanished from the resort at 4:00AM. Believed to be "air lifted" from HAL airport and moved to an undisclosed location. Trollers in social media is now asking the Congress and JD(S) to immediately take back the MLAs sitting "Dharna" in front of Raj Bhavan. Or else they may see a few more missing at the time of their return trips.
